Terms of Service
These terms are a binding agreement between you and APEX (“APEX”, “we”, “us”). They cover the APEX Minecraft server at play.apex-mc.net, this website, our Discord, and anything you buy from us.
By joining the server, entering the giveaway, or buying anything, you accept these terms. If you do not accept them, do not join and do not buy.
1. Age and parental consent
You must be at least 13 years old to use APEX. If you are under 18, you may only use APEX, enter the giveaway, or make a purchase with the permission of a parent or legal guardian, and that parent or guardian must accept these terms on your behalf.
Where a person under 18 uses APEX, their parent or guardian is responsible for that use, including any purchases made and any conduct on the server, and accepts these terms in their own right. We may ask for proof of parental consent at any time and may suspend an account until we receive it.
We do not knowingly collect personal information from children under 13. If we learn we have, we will delete it. See our Privacy Notice.
2. Your account and conduct
You are responsible for everything that happens under your account. You agree not to:
- use cheats, hacked clients, exploits, macros, X-ray or any unfair modification;
- attack, overload, scan or attempt to gain unauthorised access to our servers, infrastructure or another player’s account;
- harass, threaten, bully, dox or abuse anyone, or post content that is unlawful, hateful, sexual, or harmful to minors;
- advertise other servers, sell accounts or items for real money, or scam other players;
- evade a ban, share accounts, or use multiple accounts to gain extra giveaway entries or extra free ranks;
- impersonate staff, or misrepresent your age or your parent’s consent.
We may remove content, roll back worlds, suspend or permanently ban any account, at our discretion, with or without notice. Bans are not refunded.
3. The Season One launch offer
The free Vanguard rank (normally $9.99) is available to the first 100 unique players to join the server during the launch window. One free rank per player and per household. Alternate accounts do not qualify and may be banned.
Once 100 unique players have joined, the offer ends and the rank returns to its normal price. We determine when the limit is reached, acting reasonably, and our determination is final. We may end, extend or vary the launch window at any time before it is claimed in full.
4. Giveaway — official rules
No purchase is necessary to enter or win. A purchase will not improve your chances.
- Prize: $1000 USD, paid to one winner via PayPal. No cash alternative, substitution or transfer, except that we may substitute a prize of equal or greater value if the prize becomes unavailable.
- How to enter: submit your mobile number on apex-mc.net during the promotion period and tick the consent and age boxes. One entry per person. Joining our Discord adds one bonus entry. Maximum two entries per person. You do not have to enter the draw to play on the server, and you do not have to buy anything.
- Draw: when the server reaches 100 unique players, one winner is drawn at random, live in the APEX Discord.
- Eligibility: open to players aged 13 and over. Entrants under 18 must have a parent or guardian’s permission, and the prize will be paid to the parent or guardian on the winner’s behalf. Our staff, contractors and their immediate families may not win.
- PayPal requirement: the prize is paid to a valid PayPal account. PayPal requires account holders to be 18 or older, so a winner under 18 must nominate a parent or guardian to receive payment.
- Claiming: we will contact the winner in Discord. If a winner cannot be reached, is ineligible, or does not claim within 14 days, we may redraw.
- Taxes: the winner is responsible for any tax on the prize. We recommend getting independent advice.
- Void where prohibited. If a promotion of this kind is restricted or requires a permit where you live, this offer is not open to you.
We may cancel, suspend or amend the giveaway if it cannot run as planned — including because of technical failure, fraud, or any cause outside our reasonable control. We are not responsible for entries that are lost, delayed or not recorded.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Mojang AB, Microsoft, PayPal, Discord, Apple or Google.
5. Purchases, virtual items and refunds
Ranks, crate keys, passes and cosmetics are digital licences, not property. You get a personal, non-exclusive, non-transferable, revocable licence to use them on APEX. They have no real-world value, cannot be sold, traded or cashed out, and do not survive the closure of the server.
We may change, rebalance, retire or remove any virtual item, perk or rank at any time — including for game balance. Season-limited content is exclusive to its season and will not return.
Purchases are processed by a third-party payment provider. We do not receive or store your full card details.
Refunds
Accidental or duplicate purchases will be refunded if you open a ticket within 24 hours. Beyond that, because virtual items are delivered immediately, purchases are generally final.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If a statutory guarantee applies and cannot be excluded, our liability is limited — at our option — to resupplying the service or paying the cost of having it resupplied.
Chargebacks
If you dispute a charge with your bank or payment provider instead of contacting us first, we may permanently ban the account and remove all purchased content. If you think a charge is wrong, email us first — we will almost always sort it out.
6. The server is provided “as is”
APEX is a game server run for entertainment. We do not promise it will be available, uninterrupted, error-free, or that worlds, builds, items, ranks, statistics or progress will be preserved. Servers crash, worlds corrupt, backups fail, and seasons reset.
We may reset, wipe, roll back, modify or permanently shut down the server, any world, or any season, at any time, without notice and without compensation.
7. Assumption of risk and release
You use APEX voluntarily and at your own risk. This is a competitive faction server: players will raid you, steal from you, grief you and destroy things you built. That is the game working as intended, and it is not a basis for any claim, refund or compensation.
To the maximum extent permitted by law, you release and discharge APEX, its owners, operators, staff, moderators, contractors and volunteers from all claims, demands, losses and liabilities of any kind arising out of or connected with your use of APEX — including lost progress, lost items, lost ranks, lost time, account bans, server downtime, data loss, and the conduct of other players.
You give up any right to bring a claim against us in respect of those matters, whether it arises now or in the future, and whether or not you know about it at the time.
8. Indemnity
You agree to indemnify, defend and hold harmless APEX, its owners, operators, staff, moderators, contractors and volunteers from and against all claims, liabilities, damages, losses, penalties, fines, and costs (including reasonable legal costs on a full indemnity basis) arising out of or in connection with:
(a) your use of APEX; (b) your breach of these terms; (c) your breach of any law or of any third party’s rights, including intellectual property and privacy rights; (d) any content you upload, build, post or transmit; (e) your conduct toward other players; and (f) where you are under 18, any use of APEX by you — for which your parent or guardian is responsible.
This indemnity survives termination of these terms and continues after you stop using APEX.
9. Limitation of liability
To the maximum extent permitted by law, and subject to the consumer-rights note in section 5:
(a) we are not liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for loss of profit, revenue, data, goodwill, opportunity or anticipated savings, however caused, even if we were told the loss was possible;
(b) our total aggregate liability to you for all claims connected with APEX is limited to the greater of the amount you actually paid us in the 12 months before the claim arose, or AUD $100; and
(c) we are not liable for the acts or omissions of other players, or of any third-party service — including Mojang, Microsoft, Discord, PayPal, our payment processor or our hosting provider.
Nothing in these terms limits liability that cannot be limited by law, including for fraud, death or personal injury caused by negligence.
10. Minecraft, Mojang and Microsoft
APEX is an independent, community-run server. It is not affiliated with, endorsed, sponsored or approved by Mojang AB or Microsoft. You need your own valid Minecraft account, and your use of Minecraft remains subject to Mojang’s own EULA, usage guidelines and commercial guidelines.
“Minecraft” is a trademark of Mojang AB. All APEX branding, worlds, builds, plugins, systems and written content are our intellectual property or licensed to us, and may not be copied or reused without permission.
11. Communications
By giving us your mobile number you agree to receive text messages from APEX about Season One, the launch giveaway and your free rank. Message frequency varies; message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Consent is not a condition of joining the server, entering the draw, or making any purchase. You must be 13 or older to give us your number, and if you are under 18 you need a parent or guardian’s permission first.
We may also contact you in Discord or by email about your account, your purchases, the giveaway, and changes to these terms. You cannot opt out of essential service messages while you hold an account.
12. Privacy
We handle your personal information as described in our Privacy Notice, which forms part of these terms.
13. Suspension and termination
We may suspend or terminate your access at any time, for any reason, including breach of these terms. You may stop using APEX at any time. Sections 5 to 9 and 14 survive termination.
14. Changes, governing law and disputes
We may update these terms. Material changes will be announced on this site or in Discord, and the effective date above will change. Continuing to use APEX after a change means you accept it.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that place. If you have a problem, contact us first at [email protected] — we will try in good faith to resolve it before anyone goes to court.
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
